1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and RealtorEye, LLC (“RealtorEye,” “we,” “us,” or “our”) governing your access to and use of the RealtorEye platform, including our website at realtoreye.com and all related services (collectively, the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

RealtorEye provides automated real estate market intelligence services delivered via email and accessible through a web-based dashboard. The Service includes:

  • Daily automated market intelligence reports for unlimited ZIP code territories
  • Email delivery of personalized market analysis
  • Web dashboard access for report archives and account management
  • Market data sourced from ATTOM Data Solutions and other professional real estate data providers
  • Opportunity identification, trend analysis, and market velocity calculations
  • Flat-rate subscription with unlimited market coverage

The Service is designed exclusively for licensed real estate professionals and industry participants for legitimate business purposes.

3. Eligibility and Account Registration

3.1 Eligibility Requirements

To use the Service, you must:

  • Be at least 18 years of age
  • Be a licensed real estate professional or otherwise legitimately engaged in the real estate industry
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Maintain the security and confidentiality of your account credentials

3.2 Account Registration

You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Immediately notify us of any unauthorized use of your account
  • Accept responsibility for all activities occurring under your account

3.3 Account Restrictions

You may not:

  • Create multiple accounts for the same individual
  • Share your account credentials with others
  • Transfer or assign your account to another party without our written consent
  • Use another person’s account without permission

4. Subscription Plans and Pricing

4.1 Service Description

RealtorEye offers flat-rate subscription plans with unlimited ZIP code coverage:

  • Daily automated market intelligence reports for unlimited selected ZIP code territories
  • Email delivery of personalized market analysis
  • Web dashboard access for report archives and account management
  • Market data sourced from ATTOM Data Solutions and other professional data providers
  • Opportunity identification, trend analysis, and market velocity calculations

4.2 Pricing and Grandfathered Rates

  • Founding Circle Members: Customers who joined during the Founder’s Circle pre-launch receive permanently grandfathered pricing and enhanced referral benefits (2 months free per successful referral).
  • Beta Users: Customers who joined during the Beta Program receive permanently grandfathered pricing.
  • Standard Subscribers: Regular pricing applies at current published rates.

Grandfathered pricing is permanently locked and immune to future rate increases, provided your subscription remains active and in good standing. All subscription plans include unlimited ZIP code coverage.

4.3 Billing and Payment

  • Subscriptions are billed on a recurring monthly or annual basis
  • Flat monthly or annual rate for unlimited ZIP code coverage
  • You may add or remove ZIP codes from your coverage at any time at no additional charge
  • Annual subscriptions receive a discount (typically equivalent to two months free)
  • Payment is processed automatically via Stripe on your billing date
  • You authorize us to charge your payment method for all subscription fees

4.4 Price Changes

We reserve the right to modify pricing for the Service at any time. Price changes will:

  • Be communicated to you at least 30 days in advance
  • Not affect grandfathered pricing for Founding Circle Members or Beta Users
  • Take effect at your next billing cycle after the notice period
  • Provide you the option to cancel before the price change takes effect

Your flat-rate subscription price remains fixed as long as you maintain an active subscription.

5. Free Trial and Money-Back Guarantee

5.1 30-Day Money-Back Guarantee

  • Request a refund within 30 days of your initial subscription date
  • Contact support at realtoreye dot com with your refund request
  • Receive a full refund of subscription fees paid
  • Account access will be terminated upon refund processing
  • This guarantee applies only to your first subscription with RealtorEye

5.2 Refund Processing

  • Refund requests are processed within 5-7 business days
  • Refunds are issued to the original payment method
  • Pro-rated refunds are not available for mid-cycle cancellations after the 30-day guarantee period

6. Referral Program

6.1 Program Overview

RealtorEye operates a referral program allowing customers to earn free service months for successful referrals:

  • Founding Circle Members: 2 months free service per successful referral
  • Subscribers: 1 month free service per successful referral

Rewards are applied as service credits that extend your subscription at no additional charge.

6.2 Referral Qualification

A referral is considered “successful” and qualifies for rewards when:

  • The referred individual signs up using your unique referral code or link
  • The referred individual completes payment for their subscription
  • The referred individual remains an active subscriber for at least 30 days (past the money-back guarantee period)
  • The referred individual’s account is in good standing

Referrals that cancel within the 30-day money-back guarantee period do not qualify for rewards.

6.3 Referral Restrictions

You may not:

  • Refer yourself or create accounts to claim referral bonuses
  • Use misleading or deceptive practices to generate referrals
  • Spam or engage in unsolicited commercial outreach
  • Violate any applicable laws or regulations in your referral activities
  • Create fake or fraudulent referrals

6.4 Reward Distribution

  • Service credits are automatically applied to your account within 7 days after the referred subscriber completes 30 days of active service
  • Credits extend your subscription by the applicable number of free months
  • Credits are applied to your next billing cycle
  • No cash value or alternative compensation is provided
  • We reserve the right to withhold rewards for suspicious or fraudulent referrals

7. Cancellation and Termination

7.1 Cancellation by User

You may cancel your subscription at any time by:

  • Logging into your dashboard and selecting “Cancel Subscription”
  • Contacting support at realtoreye dot com with your cancellation request
  • Following the cancellation confirmation process

Upon cancellation:

  • You retain access through the end of your current billing period
  • No refunds are provided for partial billing periods (except within the 30-day guarantee)
  • Automatic billing ceases at the end of the current period
  • Your data will be deleted in accordance with our Data Retention Policy

7.2 Termination by RealtorEye

We reserve the right to suspend or terminate your account immediately if:

  • You violate these Terms of Service
  • You engage in fraudulent or illegal activity
  • Your payment method fails and you do not update payment information within 14 days
  • You misuse the Service in a manner that harms RealtorEye or other users
  • You attempt to circumvent technical or security measures
  • We are required to do so by law or legal process

7.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service immediately ceases
  • You remain liable for any outstanding fees or charges
  • Provisions that should survive termination will remain in effect (including Sections 8, 9, 11, 12, 13, and 14)
  • Your data will be deleted in accordance with our data retention policies

8. Acceptable Use Policy

8.1 Permitted Use

You may use the Service only for:

  • Legitimate real estate business purposes
  • Personal market intelligence and research
  • Professional decision-making and client advisory
  • Compliance with all applicable laws and regulations

8.2 Prohibited Use

You may not:

  • Use the Service for any illegal purpose or in violation of any laws
  • Resell, redistribute, or sublicense Service data without written permission
  • Use the Service to harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems or data
  • Use automated tools to scrape, harvest, or collect data from the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Remove or modify any proprietary notices or labels
  • Use the Service to compete with RealtorEye or create a competing product
  • Interfere with or disrupt the Service or servers
  • Transmit viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Violate any third-party rights, including intellectual property or privacy rights

8.3 Enforcement

Violation of this Acceptable Use Policy may result in:

  • Warning and request for corrective action
  • Suspension of Service access
  • Immediate termination of your account
  • Legal action and pursuit of damages
  • Reporting to law enforcement authorities

9. Intellectual Property Rights

9.1 RealtorEye Intellectual Property

The Service and all content, features, and functionality (including but not limited to software, algorithms, designs, text, graphics, logos, and data processing methods) are owned by RealtorEye, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Access and use the Service for your personal business purposes
  • View and download reports generated for your account
  • Use the Service in accordance with these Terms

This license does not include the right to:

  • Use the Service for commercial purposes beyond your personal business use
  • Reproduce, distribute, or create derivative works from Service content
  • Redistribute market data or intelligence reports to third parties
  • Use Service content or data for competing products or services

9.3 Data Source Attribution

Market data provided through the Service is sourced from ATTOM Data Solutions and other professional real estate data providers. This data is licensed to RealtorEye and sublicensed to you solely for personal use within the Service. You may not:

  • Reproduce, republish, or redistribute source data
  • Use data in violation of data provider terms
  • Create databases or derivative products using Service data

9.4 Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas about the Service (“Feedback”), you grant us an unrestricted, perpetual, irrevocable, worldwide, royalty-free license to use, modify, and commercialize such Feedback without any obligation to you.

10. Data and Market Intelligence

10.1 Data Accuracy

While we strive to provide accurate and timely market intelligence:

  • Data is sourced from third-party providers and may contain errors or omissions
  • Market intelligence is algorithmically generated and may not be perfectly accurate
  • We do not guarantee the accuracy, completeness, or timeliness of any data
  • You should independently verify all data before making business decisions

10.2 Not Professional Advice

The Service provides market intelligence and data analysis but does not constitute:

  • Professional real estate advice
  • Legal, financial, or tax advice
  • Investment recommendations
  • Appraisal or valuation services

You are solely responsible for your business decisions and should consult appropriate professionals when needed.

10.3 Third-Party Data Providers

The Service relies on data from ATTOM Data Solutions and other third-party providers. These providers:

  • Have their own terms and conditions that apply to the underlying data
  • May change data formats, coverage, or availability without notice
  • Are not liable for any errors or omissions in their data

10.4 Data Usage Restrictions

Market data and intelligence provided through the Service:

  • May only be used for your personal business purposes
  • May not be resold, redistributed, or commercialized
  • May not be used to create competing products or services
  • May not be aggregated with other data sources for commercial purposes

11. Disclaimers and Limitations of Liability

11.1 Service Provided “As Is”

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
  • IMPLIED WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE

We do not warrant that:

  • The Service will meet your requirements or expectations
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will be free from viruses or other harmful components

11.2 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall RealtorEye, LLC, its officers, directors, employees, agents, suppliers, or licensors be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages, including:
    • Loss of profits, revenue, or business opportunities
    • Loss of data or information
    • Loss of goodwill or reputation
    • Business interruption
    • Cost of substitute services
  • Whether arising from:
    • Breach of contract
    • Tort (including negligence)
    • Strict liability
    • Any other legal theory

Aggregate Liability Cap: Our total aggregate liability for all claims arising from or relating to the Service shall not exceed the greater of:

  • The amount you paid to RealtorEye in the 12 months preceding the claim, OR
  • $100

11.3 Basis of the Bargain

You acknowledge that the disclaimers and limitations of liability in this Section 11 are essential elements of the agreement between you and RealtorEye, and that RealtorEye would not provide the Service to you without these limitations.

11.4 Jurisdictions Prohibiting Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless RealtorEye, LLC and its officers, directors, employees, agents, affiliates, suppliers, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any law or regulation
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your referral activities or misrepresentations
  • Any content you submit or transmit through the Service
  • Your fraudulent or illegal activities

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at admin at realtoreye dot com and attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email or phone.

If we cannot resolve the dispute within 30 days of receiving notice, either party may proceed with formal dispute resolution as outlined below.

13.2 Binding Arbitration

Agreement to Arbitrate: You and RealtorEye agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, “Disputes”) will be settled by binding arbitration, except as set forth in Section 13.3.

Arbitration Rules: Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes.

Arbitration Location: Arbitration may be conducted in:

  • The state where you reside, OR
  • Wyoming (RealtorEye’s state of incorporation), OR
  • Remotely via telephone or videoconference if all parties agree

Arbitration Costs:

  • For claims under $10,000: RealtorEye will pay all arbitration filing fees and arbitrator fees
  • For claims over $10,000: Fees will be allocated according to AAA rules
  • Each party is responsible for their own attorney’s fees unless the arbitrator awards fees to the prevailing party

Arbitrator Authority: The arbitrator has exclusive authority to:

  • Resolve any dispute regarding the interpretation, applicability, or enforceability of these Terms
  • Award any relief that would be available in court under law or in equity
  • Not award relief in excess of what these Terms provide

Award Enforcement: Any arbitration award may be entered as a judgment in any court of competent jurisdiction.

13.3 Exceptions to Arbitration

The following disputes are not subject to arbitration:

  • Claims brought in small claims court (for disputes under the jurisdictional limit)
  • Claims seeking injunctive or equitable relief for intellectual property infringement
  • Claims that cannot be arbitrated under applicable law

13.4 No Class Actions

YOU AND REALTOREYE AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU AND REALTOREYE WAIVE ANY RIGHT TO:

  • Pursue claims in a class action, consolidated, or representative capacity
  • Participate in or be represented in a class action or representative proceeding
  • Bring claims on behalf of other customers or the general public

If a court determines that this class action waiver is unenforceable, the arbitration agreement in Section 13.2 will be deemed null and void, and the dispute will be resolved in court under Section 13.5.

13.5 Governing Law and Venue

These Terms and any disputes not subject to arbitration shall be governed by the laws of the State of Wyoming, without regard to its conflict of laws principles.
If arbitration does not apply, you agree that any judicial proceeding will be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to personal jurisdiction in these courts.

13.6 Severability

If any provision of this dispute resolution section is found to be unenforceable, the remainder shall continue in full force and effect.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Data Policy, constitute the entire agreement between you and RealtorEye regarding the Service and supersede all prior agreements, representations, and understandings.

14.2 Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting updated Terms on our website with a new “Last Updated” date
  • Sending email notification to your registered email address
  • Providing in-Service notifications

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cancel your subscription.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. Any waiver must be in writing and signed by an authorized representative of RealtorEye.

14.4 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

14.5 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms to any affiliate, subsidiary, or successor in interest without restriction.

14.6 No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person or entity other than you and RealtorEye.

14.7 Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, governmental actions, or failures of third-party services or data providers.

14.8 Survival

The following provisions shall survive termination of these Terms: Sections 8 (Acceptable Use to the extent of prior violations), 9 (Intellectual Property Rights), 11 (Disclaimers and Limitations of Liability), 12 (Indemnification), 13 (Dispute Resolution), and 14 (General Provisions).

14.9 Electronic Communications

By using the Service, you consent to receiving electronic communications from us, including emails to your registered email address. These communications may include notices about your account, service updates, and promotional messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
You may opt out of promotional emails by following the unsubscribe instructions in those emails, but you cannot opt out of transactional or service-related communications.

14.10 Language

These Terms are drafted in English. If these Terms are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency.
